"This disconnect between the public's view of copyright and fair use and what should and should not be prosecuted, versus the 'copyright maximist' view of the law, is our generation's Prohibition," says Ben Huh, CEO and founder of Cheezburger and a loud voice in the recent backlash to SOPA and PIPA, two congressional bills aimed at curbing internet piracy. This is my winning entry for Public Knowledge's video contest to create a response to YouTube's new "copyright school" video. While YouTube's video is generally informative about copyright law and user generated video, it falls short when it comes to its description of fair use, an exception to copyright protection that allows you to incorporate copyrighted content into your videos without the permission of the copyright holder. This video describes fair use in an easy-to-understand way, and shows that rather than being a bunch of complicated legalize that ordinary YouTube users could never understand, fair use is a simple principle that you can use as a weapon to fight abusive takedown notices and get your videos restored when they are blocked for copyright infringement. I've gotten so many messages about this bill in the last few days. Click the time stamps below to skip ahead to a topic of interest. Many people don't realize that it's already illegal to post copyrighted content online (movies, tv shows, music, and video game footage). If you look on the back of any video game you own you will see a phrase saying something like "Unauthorized copying, reverse engineering, transmission, public performance, rental, pay for play, or circumvention of copy protection is strictly prohibited." People have already been striked on YouTube for posting gaming footage even with commentaries before this bill was ever proposed. The perfect example would have to be last year when Red Dead Redemption came out. Rockstar Games flagged many videos that were uploaded of that game without their permission. This is also why big YouTubers like Freddiew can't use video game footage in their videos. In fact, I remember Freddiew talking about how it took him a long time to get a YouTube partnership because of a guitar hero video he had when he 1st started. YouTube was worried that his video might get a strike and it delayed his partnership offering. He would need to get a separate YouTube gaming kind of partnership if he wanted to use gaming footage in videos. I don't think we need to panic because most game developers do not flag videos on YouTube.
